Can a foreigner own land in Thailand?

Short answer

Land ownership by foreign nationals is restricted under Thai law, with narrow statutory exceptions. Condominium units may be owned by foreigners subject to the foreign ownership quota for the building set by the Condominium Act. Structures such as leases and company ownership have specific legal limits and should be checked case by case.

Arrangements designed to place land under nominee Thai shareholders carry real legal risk and are examined by the authorities. Do not adopt a structure because it is common; adopt it because counsel has confirmed it for your facts.

For any property transaction, the title document, the encumbrance position and the seller's authority should be verified at the Land Office before money moves.
