Wills, estates and inheritance in Thailand

In short

Succession is governed by Book VI of the Civil and Commercial Code, which sets out statutory heirs in classes and the formal requirements for a valid will. Assets located in Thailand are commonly dealt with under a Thai will and a Thai estate administration process.

A separate Thai will covering Thai-situs assets, drafted so that it does not revoke a foreign will covering assets elsewhere, is the usual arrangement for people with assets in more than one country. The revocation clause is where this goes wrong most often.

Administration generally requires a court-appointed estate administrator before banks and the Land Office will act. Original documents — death certificate, marriage and birth certificates, title documents — with certified translations where they are foreign, form the core of the application.
