Family and status matters in Thailand run on Book V of the Civil and Commercial Code (marriage, parental power, divorce) and Book VI (succession), executed through the district office (amphoe) for registration and through the courts where a judgment is needed. Cross-border cases add an authentication layer: since 22 December 2024 Thailand is a Contracting Party to the 1961 Apostille Convention, so Thai civil status documents used in another Contracting Party are certified with an Apostille from the Department of Consular Affairs.
Registering a Thai–foreign marriage
A marriage is legally effective in Thailand only when registered at a district office; a ceremony alone does not create the legal status. A foreign national is normally asked for an affirmation of freedom to marry issued or notarised through their embassy, translated into Thai and certified by the Department of Consular Affairs before the registrar will accept it.
Where one party does not speak Thai, the registrar will usually require an interpreter to attend and to be identified on the register. Requirements differ slightly between district offices, so confirming the document list with the specific office beforehand avoids a wasted appointment.
Divorce: administrative and judicial routes
An uncontested divorce where both parties attend can be registered administratively at a district office. Where consent is absent, or where custody, maintenance or property division is disputed, the matter proceeds to the court, which decides on statutory grounds.
A divorce granted abroad is not automatically reflected in Thai records. Recognition and the updating of Thai civil status records is a separate process, and the foreign judgment will need authentication and a Thai translation.
Children: legitimation, custody and adoption
A child born to unmarried parents is legally the mother's child until legitimation occurs by subsequent marriage, by registration at the district office with the mother's and child's consent, or by court judgment. Legitimation is what gives the father parental power and inheritance rights on the paternal side.
Adoption is governed by the Child Adoption Act and administered through the Department of Children and Youth, with intercountry adoption subject to additional procedure. Timelines here are set by the authority, not by the applicant.
Wills, estates and cross-border assets
Book VI of the Civil and Commercial Code recognises several will formats, including a will made in writing with two witnesses and a will made before a district officer. An estate in Thailand usually requires a court-appointed administrator before banks and the Land Office will act.
Where the deceased held assets in more than one country, the safest structure is a separate will covering Thai-situs assets drafted so it does not revoke the foreign will, and vice versa.
Using Thai status documents abroad
Marriage certificates, birth certificates, divorce registrations and household registration extracts are issued in Thai by the district office. For overseas use they are translated, certified by the Department of Consular Affairs, and then either Apostilled (for Contracting Parties) or legalised at the destination embassy (for non-Contracting States).

Frequently asked questions
Is a temple or church ceremony a legal marriage in Thailand?
No. Under Book V of the Civil and Commercial Code the marriage takes legal effect on registration at the district office. A ceremony may be culturally essential but it is not the legal act.
Can we divorce at the district office if one of us is abroad?
Administrative divorce requires both parties to appear before the registrar. If one party cannot attend, the practical route is usually a court process; a power of attorney is not generally accepted as a substitute for personal appearance in the registration itself.
How is a child legitimated by the father?
By the parents' subsequent marriage, by registration at the district office with the consent of the mother and the child, or by a court judgment where consent cannot be given or is refused. Until then parental power rests with the mother.
Do we need a Thai will if we already have one abroad?
It is usually advisable for Thai-situs assets, because Thai banks and the Land Office work with Thai court processes. The two wills must be drafted so neither revokes the other.
Does Thailand now issue Apostilles?
Yes. The 1961 Apostille Convention entered into force for Thailand on 22 December 2024, and the Department of Consular Affairs of the Ministry of Foreign Affairs is the competent authority. Documents for non-Contracting States still go through embassy legalisation.
