Should we apply for BOI promotion or a foreign business licence?
Short answer
They answer different questions. BOI promotion is about incentives for a qualifying activity; a foreign business licence is about permission for a foreign-majority company to carry on a restricted activity. A BOI-promoted project may obtain a foreign business certificate through that channel.
Start from the activity. If it appears on the BOI list and meets the conditions, the promotion route often solves both problems at once.
If it does not qualify for promotion but falls inside the Foreign Business Act schedules, the licence route or a Thai-majority structure has to be considered on its merits.
